Damage claim / Liability

lf you are of the opinion you have suffered damage as a result of your treatment at Maastricht UMC+, you may hold Maastricht UMC+ liable. You can do this yourself or with the help of, for example, a lawyer or legal assistance insurance. Maastricht UMC+ is insured for liability with Everest lnsurance (lreland} DAC. Maastricht UMC+ handles liability claims on behalf of Everest lnsurance.

  • What is required to investigate a claim.

    After receiving your claim, Maastricht UMC+ will send you a confirmation of receipt. You will be asked to sign and return an authorization, along with a copy of your ID. By doing so, you authorize Maastricht UMC+ to request your medical information relevant to the assessment of the claim and to ask the employee(s) involved to respond to your allegations. The copy of your ID will be destroyed after verification. Your medical information will be used solely for the purpose of investigating your claim. You can revoke the authorization at any time The investigation also requires that you substantiate your claim.. lt must be clear what reproach you make against Maastricht UMC+, what was done wrong, how the treatment should have gone differently and what your damage is. Once the authorization, the copy ID and the substantiation have been received, the investigation into your liability will start. You will receive an interim progress report at that time.

    The claim investigation

    Maastricht UMC+ will conduct an investigation into the facts and circumstances relevant to assessing your claim. For this purpose, a recommendation is usually requested from an external damage assessment agency. This is either the Sedgwick expert bureau in Rotterdam, or the DEKRA Personenschade expert bureau in Arnhem, or the Mclarens expert bureau in Utrecht.You will be notified when one of these agencies is called in. An employee of Sedgwick, DEKRA Personenschade or Mclarens will then contact you or your representative. lf you wish, you can explain your claim to this employee in an interview. This conversation can take place by phone or at your home. A claims expert and a medical advisor from Sedgwick, DEKRA or Mclarens will then assess your claim and give advice on it to Maastricht UMC+. Maastricht UMC+ will take a position thereafter. lf liability is recognized, the damages and the amount of damages will then be determined.

    Handling time

    Maastricht UMC+ will try to settle your claim as quickly as possible. lf advice is requested from the Sedgwick, DEKRA or Mclarens office, this time limit will be extended. You will be informed about this and you will be informed in the meantime.

    GOMA code of conduct, Maastricht UMC+ Wkkgz complaints procedure

    In handling your claim Maastricht UMC+ observes the Wkkgz and the GOMA Code of Conduct. GOMA stands for Gedragscode Openheid Medische Incidenten. You can find the full text of the procedures on the Maastricht UMC+ website or request them.

    Objection

    Should you disagree with the decision made by Maastricht UMC+ regarding your claim, you can submit a written substantiated objection. Maastricht UMC+ will then re-assess whether your objections are well-founded and may propose to present the case together with you to an independent expert.

    lf you do not agree with the outcome and your damages do not exceed € 25,000, you may submit this dispute with Maastricht UMC+ to the Health Care Disputes Committee in The Hague. Information can be found on the website www.degeschillencommissie.nl 
    Also, a dispute about damage can be submitted to the civil courts.

If you are of the opinion that damage has been caused by the actions of employees of Maastricht UMC+, you can hold Maastricht UMC+ liable for this by sending a letter or completing the Maastricht UMC+ Liability Form  to:

Maastricht UMC+, the medical specialists and other employees of Maastricht UMC+ are insured for professional liability with Everest Insurance (Ireland) DAC.

Damage or loss of property

In the event of property damage, for example damaged or lost property, you can invoke the third-party liability insurance of Maastricht UMC+. To do this, you can fill in the Damage/Loss Report Form (formulier vermissingen; in Dutch)  and submit it to AON Maastricht UMC+ (Postbus 5800, 6202 AZ Maastricht) or email the completed form to rudolf.gokemeijer@aon.nl
